1. Your Agreement With Us 

 When you purchase a ticket for a Jolly Pumpkin event, you agree that these Terms & Conditions form part of the contract between you and R M Wright trading as Jolly Pumpkin (“Jolly Pumpkin”, “we”, “us” or “our”).

The person making the booking is responsible for ensuring that all members of their booking group are aware of and comply with these Terms & Conditions.

Jolly Pumpkin events take place on working farmland and in an outdoor agricultural environment. By visiting, you acknowledge that there are inherent risks associated with this type of environment, including uneven or slippery ground, mud, vegetation, changing weather conditions, agricultural crops, natural obstacles and other countryside hazards.

Visitors are responsible for taking reasonable care of themselves and those within their group and must follow all instructions given by Jolly Pumpkin staff.

Nothing within these Terms & Conditions excludes or limits any liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence.

2. Children & Supervision

Any person under the age of 16 must be accompanied and appropriately supervised by a responsible adult at all times while on site.

Parents, guardians and accompanying adults remain responsible for the behaviour and supervision of children within their group, including when using play equipment, attractions, props and other facilities.

Children must not be left unattended.

3. The Farm Environment

Jolly Pumpkin is an outdoor event held within a farm environment.

Visitors may encounter plants, crops, weeds, fungi, berries, insects, animals and other naturally occurring flora and fauna. Some of these may be unsuitable for human consumption or may cause irritation or an allergic reaction.

Visitors must not consume any plant, fruit, berry, fungi or other naturally occurring item unless it has specifically been offered or sold by Jolly Pumpkin as suitable for consumption.

Visitors are responsible for ensuring that children and other members of their group follow this requirement.

4. Tickets

All tickets are valid only for the Jolly Pumpkin location, date and arrival time stated on the booking.

Tickets are sold for a specific date and time and are non-refundable where a customer changes their mind or is unable to attend.

As tickets relate to a leisure activity taking place on a specific date, the normal 14-day online purchase cooling-off period does not generally apply.

Tickets may not be resold for commercial gain.

Where permitted by our ticketing system, tickets may be exchanged for another available date or time up to 7 days before the booked attendance date, subject to availability.

Ticket exchanges must be made through the customer self-service portal using the link provided within the original booking confirmation.

Once within 7 days of the booked attendance date, tickets cannot normally be exchanged.

This does not affect your statutory rights.

5. Arrival Times

The time shown on your ticket is your arrival time, not your departure time.

Please arrive within the time slot stated on your ticket. Once admitted to the event, you are welcome to remain on site until the advertised closing time for that day.

We cannot guarantee entry if you arrive significantly outside your booked arrival time, particularly during busy periods.

6. Carer / Companion Tickets

Where Jolly Pumpkin offers a carer or companion ticket, reasonable evidence of eligibility may be requested at the entrance.

Accepted evidence may include:

  • an Access Card;
  • evidence of Disability Living Allowance (DLA);
  • Personal Independence Payment (PIP);
  • Attendance Allowance; or
  • other reasonable supporting evidence of the requirement for a carer or companion.

Please contact Jolly Pumpkin before visiting if you are unsure whether the evidence you have will be accepted.

7. Weather, Safety & Site Closure

As an outdoor agricultural event, Jolly Pumpkin is affected by weather and ground conditions.

We reserve the right to temporarily close areas, alter attractions, restrict access or close the site where we reasonably consider it necessary for the safety of visitors, staff or contractors.

This may include circumstances involving severe weather, flooding, high winds, dangerous ground conditions, fire, damage to the site or another event outside our reasonable control.

Where reasonably possible, customers will be informed of significant closures or changes using the contact details supplied when booking and/or through our website and social media channels.

If Jolly Pumpkin cancels an event or booked session and we are unable to provide the service purchased, we will offer an appropriate remedy in accordance with your legal rights. Depending upon the circumstances, this may include transferring your booking to another available date, providing a credit or voucher, or providing a refund.

We are not responsible for additional costs incurred by visitors as a result of an event cancellation or change where it is lawful for us to exclude such responsibility.

8. Pumpkin Crop & Availability

Pumpkins are an agricultural crop and are affected by factors outside our reasonable control.

These can include weather conditions, drought, excessive rainfall, frost, pests, disease and other agricultural or environmental factors.

For this reason, we cannot guarantee the availability of any particular pumpkin variety, size, colour or quantity on the day of your visit.

Pumpkin availability may also reduce as the season progresses.

If circumstances significantly affect the pumpkin crop or mean that we are unable to operate the event substantially as advertised, Jolly Pumpkin may alter, postpone or cancel affected sessions. Where this happens, the provisions under Weather, Safety & Site Closure above will apply.

9. Attractions, Activities & Entertainment

The attractions, entertainment, food traders, activities and other facilities available may vary between Jolly Pumpkin locations and between individual event dates.

Where circumstances outside our reasonable control require it, we may alter, substitute or withdraw individual attractions, activities, entertainment or traders without prior notice.

The temporary unavailability of an individual attraction or activity does not automatically entitle a visitor to a refund where the main event remains open and operating substantially as advertised.

Some activities may have separate age, height, capacity or safety restrictions. Visitors must follow instructions provided by staff and any signage displayed.

10. Visitor Behaviour

Visitors must behave responsibly and with consideration for other visitors, staff, contractors, neighbouring properties and the farm.

You must:

  • follow instructions given by Jolly Pumpkin staff;
  • remain within areas open to the public;
  • use designated paths and access routes where instructed;
  • not intentionally damage crops, equipment, props, attractions, fencing, buildings or other property;
  • not enter areas marked as closed, restricted or staff-only; and
  • use attractions and equipment only in the manner intended.

Anyone behaving dangerously, abusively, unlawfully or in a manner which may cause damage, nuisance or risk to themselves or others may be required to leave the site.

Where a visitor is required to leave because of their behaviour or a serious breach of these Terms & Conditions, no refund will normally be provided.

Anyone who deliberately or negligently damages property may be responsible for the reasonable cost of repairing or replacing that property where legally liable.

11. Smoking & Vaping

Jolly Pumpkin is a strictly no-smoking and no-vaping site.

This includes cigarettes, cigars, pipes, e-cigarettes and vaping devices.

This policy is particularly important because Jolly Pumpkin operates within an agricultural environment where straw, crops and other combustible materials may be present.

Anyone found smoking or vaping on site may be asked to leave immediately.

12. Dogs & Other Animals

Dogs and other pets are not permitted at Jolly Pumpkin, primarily for hygiene, livestock, crop and visitor-safety reasons.

Recognised assistance dogs are permitted.

Assistance dogs must remain appropriately controlled while on site.

13. Car Parking

Parking is provided for Jolly Pumpkin customers and may include agricultural or grass surfaces depending upon the location and conditions.

Please drive carefully, follow the directions of parking staff and be aware that surfaces may be uneven, muddy or slippery.

Vehicles and their contents are left at the owner’s risk.

Jolly Pumpkin will not be responsible for loss, theft or damage to vehicles or their contents except where such loss or damage results from our negligence or where liability cannot otherwise lawfully be excluded.

Parking is only permitted in areas designated by Jolly Pumpkin staff.

14. Personal Property

Visitors are responsible for their own possessions while attending Jolly Pumpkin.

We cannot accept responsibility for personal belongings which are lost, stolen or damaged unless the loss or damage is caused by our negligence or where liability cannot lawfully be excluded.

Any lost property handed to our staff will be dealt with in accordance with our lost-property procedures.

15. Drones

The use or operation of drones or other remotely operated aircraft anywhere within or above the Jolly Pumpkin event site is strictly prohibited unless prior written permission has been obtained from Jolly Pumpkin and all relevant legal requirements have been satisfied.

16. Photography & Filming

Photography and filming may take place during Jolly Pumpkin events for marketing, promotional and publicity purposes, including use on our website, social media channels, advertising materials and other Jolly Pumpkin publications.

Where official photography or filming is taking place, we will take reasonable steps to make visitors aware, which may include signage at the event.

If you or a member of your group does not wish to be deliberately photographed or filmed by our official photographer or videographer, please make this known to a member of staff or the photographer.

We take particular care where children are identifiable within photographs or footage and will handle photography and filming in accordance with applicable UK data-protection requirements.

Where photographs or footage have been lawfully obtained and used by Jolly Pumpkin, no payment or royalty will normally be payable to persons appearing incidentally within that content.

Visitors are welcome to take photographs and videos for their own personal use, provided that doing so does not interfere with the enjoyment or privacy of other visitors or the safe operation of the event.

Commercial photography or filming requires prior written permission from Jolly Pumpkin.

17. Events Beyond Our Reasonable Control

Jolly Pumpkin will not be responsible for a failure or delay in providing an event where this results from circumstances genuinely outside our reasonable control.

Such circumstances may include severe weather, flooding, fire, major utility or communications failures, government restrictions, outbreaks of disease, civil emergencies, war, terrorism or other exceptional circumstances.

Where such circumstances result in the cancellation of a booked event, we will deal with affected bookings in accordance with the Weather, Safety & Site Closure section of these Terms & Conditions and applicable consumer law.

18. Third-Party Traders & Contractors

Independent food traders, entertainers, photographers, activity providers or other contractors may operate at Jolly Pumpkin events.

Where goods or services are purchased directly from an independent third party, a separate contract may exist between the visitor and that third party and their own terms and conditions may apply.

Nothing within these Terms & Conditions seeks to exclude any legal responsibility Jolly Pumpkin may itself have.

19. Changes to These Terms

We may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to your booking will normally be those in force when your booking is made, although reasonable operational or safety requirements introduced after booking may also apply to your visit.

Any changes will not affect your statutory consumer rights.

20. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Nothing within these Terms & Conditions affects any statutory rights you have as a consumer.
